TERMS AND CONDITIONS OF PARTICIPATION IN THE "PACKAGE FOR CHRISTMAS" CHARITY CAMPAIGN
§ 1 Purpose of the Campaign- The purpose of the "Package for Christmas" charity campaign (hereinafter referred to as the "Campaign") is to fulfill the holiday wishes of children undergoing oncological treatment in Poland.
- The Campaign aims to enable children to prepare letters to Santa Claus and to connect their dreams with people who voluntarily wish to fulfill them.
- These Regulations define the rules and conditions for participation in the Campaign.
- The Organizer of the Campaign is the Social Committee for the "Package for Christmas" Campaign (hereinafter referred to as the "Organizer").
- The Campaign is conducted via the website www.paczkanagwiazdke.pl.
- Submitting a child to the Campaign takes place by:
- preparing a letter to Santa Claus,
- obtaining a single-use verification code at the hospital Ward,
- completing the application form available on the Organizer's website,
- uploading a photograph of the prepared letter.
- The list of hospital wards and facilities covered by the Campaign is available on the Organizer's website.
Definitions
The terms used in these Regulations shall have the following meanings:
- Campaign Participant – a child aged 0 to 18 years currently undergoing oncological treatment, including in-patient treatment at a hospital ward or maintenance therapy conducted at home, under the care of one of the wards participating in the Campaign.
- Legal Guardian – a parent or other individual authorized to legally represent the child and submitting the child's application to the Campaign.
- Donor (Santa) – an individual or entity who voluntarily undertakes to fulfill the wish of a selected child.
- Verification Code – an individual, single-use code issued by a hospital ward staff member to a child eligible to participate in the Campaign, used to confirm eligibility for application.
- Letter – a letter to Santa Claus prepared by the child containing a description of their dreams, wishes, and interests.
- Organizer – the Social Committee for the "Package for Christmas" Campaign (Komitet Społeczny na rzecz Akcji Paczka na Gwiazdkę).
- Regulations – these Terms and Conditions.
- The Organizer of the Campaign is:

e-mail: [email protected] - The Organizer is responsible for organizing the Campaign, operating the submission system, publishing letters, liaising with participants and Donors, and coordinating gift fulfillment.
- The submission of children to the Campaign begins on October 1, 2026.
- Submissions close on November 30, 2026, subject to the possibility of earlier closure if announced by the Organizer on the website.
- Gift fulfillment takes place until all available letters have been reserved.
- The Organizer will make every effort to ensure that gifts are delivered before December 24, 2026; however, the Organizer does not guarantee the fulfillment of all applications or timely delivery.
- The Organizer may shorten, cancel, or modify the Campaign schedule in the event of circumstances beyond its control. Significant changes will be announced on the website and on social media.
- The Campaign is open to children currently undergoing oncological treatment, including:
- in-patient treatment at a hospital ward,
- chemotherapy,
- radiotherapy,
- other oncological treatments,
- maintenance therapy conducted at home.
- Children who have completed oncological treatment and remain solely under medical supervision or attend check-up visits are not eligible to participate in the Campaign.
- Each child may participate in the Campaign only once per edition.
- Only one single-use verification code may be assigned to one child.
- The verification code is issued by an authorized staff member of the hospital ward participating in the Campaign. The Organizer does not require parents or children to present diagnoses, specific medical conditions, or medical records.
- The Organizer may refuse to accept an application or remove a submission if it does not meet the requirements specified in the Regulations.
- The child prepares a letter to Santa Claus in paper format.
- The letter should primarily include:
- the child's first name,
- the child's age,
- interests and hobbies,
- desired gifts.
- If necessary for gift selection, the child may also state their height, clothing size, shoe size, or other relevant gift information.
- The letter should NOT contain:
- the child's surname,
- home address,
- hospital or ward name,
- diagnosis or treatment details,
- phone number,
- email address,
- any other information that would allow direct identification of the child.
- The Organizer may request the removal of any data from the letter that should not have been included.
- The child's application is submitted by their Parent or Legal Guardian.
- In order to submit an application, the Parent/Legal Guardian:
- prepares or helps the child prepare the letter,
- obtains a single-use verification code from ward staff,
- takes a clear, good-quality photograph of the letter,
- fills in the application form on www.paczkanagwiazdke.pl,
- uploads the photo of the letter and enters the verification code received.
- The value of the gift should not exceed 320 PLN.
- The gift should not comprise more than 3 items.
- Whenever feasible, items making up the gift should be available in a single shop or location to minimize shipping costs incurred by the Donor.
- The Parent/Legal Guardian is obliged to provide complete and accurate information in the form necessary for contact and delivery of the gift.
- In particular, a correct delivery address or data required for delivery to a selected parcel locker (Paczkomat) must be provided.
- The Parent/Legal Guardian undertakes to collect the shipment in a manner and timeframe that allows for successful delivery.
- The Parent/Legal Guardian is responsible for the accuracy of contact and delivery details provided.
- The Organizer does not guarantee the fulfillment of all submitted wishes.
- The Organizer is not liable for delays or inability to deliver a gift due to reasons beyond the Organizer's control.
- The list of children's wishes is published on the Organizer's website.
- Prior to selecting a wish, the Donor can view in particular:
- the child's first name and age,
- description of the wish.
- After reserving a selected letter, the Donor receives access to the full content of the child's letter.
- The Donor does not receive information regarding the name of the hospital or place of treatment.
- After selecting and preparing the gift, the Donor undertakes to upload a photo of the prepared parcel's contents via the "My Reservations" tab (available on paczkanagwiazdke.pl after logging into the system).
- After the photo is verified by the Campaign Organizers, the Donor will receive the data necessary to dispatch the gift, to the extent required for delivery.
- The Donor undertakes not to disclose the delivery address to third parties (except for courier services, Polish Post, InPost, etc.).
- The Donor undertakes to dispatch the parcel in time to enable delivery before December 24, 2026.
- The Donor will promptly notify the Campaign Organizer if, for any reason, they are unable to fulfill the child's wish.
- Parents/Legal Guardians and Donors may use a user account in the Organizer's system.
- An account may be created directly within the Organizer's system.
- If the system allows logging in via external providers such as Google or Facebook, using this option is voluntary.
- After logging into the system, the Parent/Legal Guardian has access to:
- Preview of the submitted letter,
- Form section allowing the upload of a photo of the child with the gift (visible solely to the Donor).
- After logging into the system, the Donor has access to:
- Scan of the child's letter,
- Form allowing the upload of a photo of the prepared gift, entering tracking number, and access to the photo of the child with the gift (provided the Parent/Legal Guardian uploaded such a photo).
- Upon receiving the gift, the Parent/Legal Guardian should confirm its receipt by changing the status in the system or by contacting the Organizer.
- Confirmation may be provided:
- via the system – uploading a photo of the child with the gift automatically changes the gift status to received,
- via SMS to (+48) 792 091 084,
- via email to [email protected].
- Please confirm receipt of the gift by the end of January 2027.
- Uploading a photo of the child with the received gift is completely voluntary and is not a condition for participation in the Campaign or receiving a gift.
- The Parent/Legal Guardian may voluntarily consent to sharing the photo with the Donor who fulfilled the child's wish.
- Publishing a photo containing the child's image on the Organizer's website or social media requires separate, explicit consent from the Parent/Legal Guardian.
- Refusal to provide or publish a photo does not affect the child's participation in the Campaign.
- The Controller of personal data processed in connection with the Campaign is:

phone: (+48) 792 091 084 - The Controller processes personal data of the child and their Parent/Legal Guardian to the extent necessary to:
- receive and process the application,
- verify eligibility for participation in the Campaign,
- publish the letter and information regarding the wish,
- contact the Parent/Guardian,
- fulfill and deliver the gift,
- confirm receipt of the gift,
- maintain the user account, if created.
- In connection with the participation verification process, the Organizer may process information resulting from the use of the verification code, confirming that the child meets the conditions of participation in the Campaign.
- The Organizer does not require providing diagnoses, tumor types, test results, medical documentation, or any other details regarding the course of treatment.
- To the extent that processing includes data concerning the child's health, the legal basis is explicit consent pursuant to Article 9(2)(a) GDPR. For other data processed on the basis of consent, the legal basis is Article 6(1)(a) GDPR. Health data constitutes a special category of personal data.
- Granting consent to participate in the Campaign and to data processing is not mandatory; however, lack of consent precludes the child's participation in the Campaign and gift fulfillment.
- Data necessary for delivery may be transferred to the Donor fulfilling a specific wish, exclusively to the extent required to dispatch the parcel.
- Data recipients may also include entities providing services to the Organizer necessary for the operation of the website, system, email communication, or delivery fulfillment, to the extent resulting from those services.
- The Organizer implements appropriate technical and organizational measures aimed at protecting personal data against unauthorized access, loss, alteration, or other unlawful processing.
- Data is stored for the period necessary to achieve the objectives of the Campaign, its accounting, and application processing, and is deleted thereafter, unless continued retention is required by law or the data subject has granted separate consent for further processing. The storage limitation principle requires data to be kept no longer than necessary for the purposes of processing.
- Parents/Legal Guardians are entitled to rights under the GDPR, in particular the right of access, rectification, erasure, restriction of processing, and – where applicable – data portability and the right to object.
- The Parent/Legal Guardian has the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.
- The data subject has the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych - PUODO).
- Detailed information regarding personal data processing is available on www.paczkanagwiazdke.pl. The information obligation includes details on the controller, purposes and legal basis of processing, retention periods, recipients, and rights of the data subject.
- The Parent/Legal Guardian/Donor may voluntarily consent to receiving information about future editions of the Campaign and other initiatives of the Organizer.
- This consent is voluntary and is not a condition for the child's participation in the Campaign.
- Consent may be withdrawn at any time.
- These Regulations are available at www.paczkanagwiazdke.pl throughout the duration of the Campaign.
- Information contained in promotional materials is for informational purposes only. The rules of participation in the Campaign are determined by these Regulations.
- The Organizer may amend the Regulations, provided that such changes do not violate acquired rights of participants or worsen conditions of participation in the Campaign. Information about changes will be published on the website.
- In matters not covered by these Regulations, the provisions of Polish law shall apply.
- These Regulations enter into force on the day of publication on the Organizer's website.
